Terms of Service

Welcome to PowerTread. These Terms of Service (“Terms”) govern your use of the PowerTread mobile application (the “App”), provided by NoVa Solutions Group, LLC (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. No Account Required & Data Handling

The PowerTread App is designed for immediate use without user accounts. We do not require you to create an account to use core functionality.

Your workout data, GPX course files, and personal fitness data generated or loaded within the App remain on your device. We do not collect, transmit, store, or have access to your personal workout activities on our servers.

2. Third-Party Integrations

The App may offer optional features to connect and sync activity data to third-party fitness platforms (such as Strava). These integrations are opt-in and require your authorization.

• You can authorize and deactivate these integrations at any time within App settings.
• When authorized, data is shared directly between your device and the selected service, subject to that service’s terms and privacy policy.
• We are not responsible for third-party data practices.

3. Use of the App & Health Disclaimer

The App is a tool designed to enhance treadmill training. You acknowledge and agree that:

• Use of the App is at Your Own Risk: Exercise, especially intense activity, carries inherent risk. You are responsible for exercising safely and for your physical condition.
• Consult Your Doctor: Before beginning any exercise program, including with this App, consult your physician or another qualified healthcare professional.
• Device Compatibility: You are responsible for ensuring your treadmill and sensors (including Stryd power meters) are compatible and operating correctly.
• You Must Remain in Control: You must remain in control of your treadmill at all times and be prepared to stop equipment immediately if needed.
• Environmental Awareness: Use the App only when you can safely monitor treadmill behavior, connected devices, and surroundings throughout the workout.
• Safety Precautions: Always follow all safety guidelines, warnings, and instructions from your treadmill manufacturer.

4. Intellectual Property

All content, features, and functionality of the App are owned by NoVa Solutions Group, LLC, its licensors, or other providers, and are protected by applicable intellectual property laws.

The PowerTread name, logo, and related marks are trademarks of NoVa Solutions Group, LLC or its affiliates/licensors and may not be used without prior written permission.

5. No Warranty

PowerTread is provided “as is” without warranties of any kind, express or implied. We make no guarantees regarding treadmill performance, Bluetooth connectivity, equipment behavior, or uninterrupted operation while connected to the app.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, INCLUDING WITHOUT WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE.

WE DO NOT WARRANT THE APP WILL BE ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, THAT DEFECTS WILL BE CORRECTED, OR THAT RESULTS FROM APP USE WILL BE ACCURATE OR RELIABLE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVA SOLUTIONS GROUP, LLC, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, INCLUDING PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOST PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR POWERTREAD IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $50.

7. Indemnification

You agree to defend, indemnify, and hold harmless NoVa Solutions Group, LLC, its affiliates, licensors, and service providers, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, your violation of these Terms, or your misuse of connected equipment.

8. Changes to These Terms

We may revise these Terms at our discretion. Changes are effective when posted and apply to all use of the App thereafter. Continued use after updates means you accept the revised Terms.

9. Governing Law and Jurisdiction

These Terms and any disputes related to the App are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
